SACRAMENTO, Calif. (KABC) — A California state senator has proposed new legislation aimed at ensuring that former President Donald Trump is excluded from the electoral ballot in 2028.
California state Sen. Tom Umberg, a Democrat representing Santa Ana and chairperson of the Senate Judiciary Committee, is proposing Senate Bill 46. This bill would allow the California secretary of state to request proof of a candidate’s eligibility and exclude candidates from the ballot if they are constitutionally ineligible.
Trump has repeatedly raised the idea of trying to stay in power for a third term, even though the U.S. Constitution clearly prohibits it. “Trump 2028” hats have been passed out as souvenir keepsakes to lawmakers and others visiting the White House. Additionally, Trump’s former 2016 campaign chief-turned-podcaster Stephen Bannon has revived the idea of a third Trump term.
In October, Trump acknowledged the constitutional limit, saying, “It’s too bad” he’s not allowed to run for a third term. Speaking to reporters, he stated, “If you read it, it’s pretty clear. I’m not allowed to run. It’s too bad,” while expressing interest in continuing to serve.
